Services Provided:

We aim to provide our services to make life better for all Kiwis.

We provide an online venue to connect people in various ways and to assist our members in selling unwanted goods and finding items of need at the lowest possible price.

In providing the Fetchbig venue, we don't participate in selling items or the transaction itself. We don't own any items listed on our site, nor do we act as an agent for either buyers or sellers. We also don't take part in the actual provision of member services.

Safety

We understand that our valued customers will only use Fetchbig if they trust other members and feel confident in the Fetchbig community. Our dedicated Trust and Safety team is committed to making fetchbig the safest online marketplace for all. While we can't pre-screen listings or monitor every transaction, we'll take the appropriate action if we become aware of any misuse of our services. This could be issuing a warning, removing content, deactivating an account, permanently banning a member, or contacting the relevant authority.

 

Some examples of the kind of misuse we'd take action over are: 

• illegal, stolen or unsafe Items.
• Listings that do not comply with New Zealand law, infringe intellectual property rights or harmful or offensive conduct. 
• We may also limit your activities on our site based on your off-site conduct, such as prior criminal convictions, insolvency, or any other conduct that puts our community or systems at risk. 

You agree that we may disclose your personal information in accordance with our privacy policy, including your name and contact details, as well as any transactional records, site interactions or other relevant information, to the relevant authorities, parties and/or intellectual property rights holders.

Additional Services 

We offer many additional services to make our venue easier to use and make life better for all Kiwis.

 

For example:

Our book-a-courier service means members can send all sorts of items, including items they've sold onsite.

Our MotorWeb service means sellers can easily display key vehicle information on their listing, which ensures buyers are informed and confident about a vehicle.

 

License and intellectual property rights.

To enable you to use and enjoy our services, we grant you a limited, non-exclusive, non-transferable and revocable licence to use our site and services in accordance with our Terms.

We retain all of our intellectual property rights, including our rights in the software and source code used, to provide the site and services. You may not adapt, reproduce, copy, store, distribute, publish or create derivative works from any part of the site or commercialise or on-sell any information obtained from the site or our services without our prior written consent.

In general We own our site.We grant you a limited licence to use it, but you can't copy it.

 

Funds:

The service fees or any funds paid will be held in stripe and a separate company account,

We may deduct the amount stated in our terms, and you agree that you have no right to any interest earned on amounts deposited in this account. Unless clearly stated in our terms, no charges other than our service fees will be applied to Fetchbig account balances

Note:   At any point, we can refund any service charge if you see that it's not applicable and is mutually agreed upon.

 

Notice:

We have the right to provide reasonable notice while upgrading or closing the site for any reason.

 

Membership critria:

It's free to become a Member of fetchbig.co.nz,  To become a Member you must have the below mentioned critria.

a. Be at least 18 years old and able to enter into contracts;

b. Be a resident in New Zealand or Australia (unless we specifically agree with you otherwise); and

c. All information provided should be accurate to the best of your ablities.

We may allow you to register or log in to some of our services with a third-party service (e.g. Facebook or Google), in which case we will access, store and use your information from that service, subject to their terms. Our privacy policy covers this also.

To use our services, you only need one account. So, you can't register as a member under multiple identities, persons, or aliases (whether false or not). You may create a business membership in addition to your personal membership.

 

You must maintain and update your personal and account information to always be current and correct. We may contact you to verify your details.

 

You're responsible for all the activity that happens on your account. To protect it, keep your login information secret and secure, change your password regularly, and don't let anyone else use your membership.

 

Our members work hard and rely on the feedback placed by others. Unless we give specific prior approval, your membership is not transferable and can't be sold, leased, lent or traded. Your Account:

Each client has a unique account; you can check your account balance anytime. Your account is used to pay all service fees. You can't pay for goods purchased from your account. Goods purchased are then paid for in cash, bank transfer, direct debit or whatever is agreed between the buyer and seller.

If membership is terminated for any reason, the balance available in your account will be paid back into your registered account number unconditionally. If an account has not been used in 24 Months, the account will be automatically suspended. Any unused balance will not be refunded and will be fortified. Please get in touch with us to reuse your account.

Any bonuses earned or any promotional credits in any form will not be refunded.

 

Communication:

We shall communicate about your account when it is deemed necessary. This could be regarding promotions or any other Fetchbig activities. We send emails and newsletters on a timely basis.

Termination:

Fetchbig reserves the right to terminate your account at any point in time without prior consent. In a situation where we have terminated, Fetchbig reserves the right to inform you of the reason for complete or partial termination.

In a situation where fetchbig has terminated the account, you promise that you will not be using the account in the future, nor will you try to log in with a different account or use our service.

 

Commitments from client:

Basic Principles

       The community expects buyers and sellers to:

• Conduct themselves honestly and in good faith at all times.
• Comply with all laws, including the sale of goods and intellectual property laws.
• Comply with fetchbig.co.nz terms and conditions.

 

Sellers agree to:

• Describe items fully and accurately and answer questions promptly.
• Respond to emails as soon as possible and within two working days.
• Ensure items are shipped as soon as possible and within a week of receiving payment and delivery address unless indicated in the listing or agreed upon by both parties.
• Shipping charges should not be inflated for profit and must be a fair and reasonable reflection of the actual packaging and postage costs.
• Only place negative feedback with making best endeavours to resolve issues through email first or phone call.
• Do not engage in retaliatory feedback or behaviour.
• Refrain from spamming previous buyers

 

Buyers agree to:

• Respond to emails as soon as possible and within two working days.
• Pay for goods purchased as soon as possible or whenever is agreed upon between the buyer and seller. This should be within a week of the auction closing and receiving payment details.
• Only place negative feedback with making best endeavours to resolve issues through email first or phone call.
• Do not engage in retaliatory feedback or behaviour.
• Refrain from spamming previous sellers..               

 

Resolving Issues and problems.

We encourage members to try and resolve disputes on their own; it has to be addressed directly between the buyers and sellers.

 We want you to be aware that the dispute is between the buyer and seller; we will not be able to help you since we value our client's privacy. Suppose the dispute is taken to a third party, like a dispute tribunal or any relevant organisation. In that case, we can only release the member's details by going through the declaration process.

Service Dispute:

Regarding a dispute about our service, please get in touch with Fetchbig, and we shall try to resolve it as soon as possible. In case we need to contact you about the dispute, we shall call you or email you with the most recent details you have provided

If you find anything misleading, we shall immediately address it and try to rectify it.

Note: We are not a party in any transaction between you and another fetch big.co.nz member.Disputes can be taken to a dispute tribunal or committee. We will only release the member details if you agree to this and can provide a declaration form if required.

Fetchbig is not yet a member of the financial dispute resolution services (But will be soon). We don't have any financial involvement between Fetchbig members apart from our service charge.

 

Fetchbig is a proud Kiwi company aiming to bring all Kiwis the best possible service.

 

System issue:

We aim to provide continuous and safe services, but this is not 100% guaranteed. We will try our best to rectify any issues a user may have while using Fetchbig.

 

Libiality:

Our liability to you is not more than the service charge we apply. We are not a party to the transactions between you and the buyer.

 

Caracter and conduct.

We do not take responsibility for any untoward conduct and do not prescreen the product listing, communication, etc.

We shall do it only in a situation where a complaint has been filed, and it is limited to removing the listing or comments and restricting the users' activities on fetchbig.co.nz

Note: You agree that in any situation of a breach or any issues in the site fetchbig.co.nz is not responsible.

 

These above terms will always apply when you use fetchbig.co.nz. We may modify these terms at any time, and such changes will be effective upon posting.
